Caspera provides web design and development services for tradespeople and non-profit organizations. Our services include website design, web development, maintenance, and search engine optimization.

We reserve the right to withdraw or amend our services, and any service or material we provide, in our sole discretion without notice. We will not be liable if for any reason all or any part of our services are unavailable at any time or for any period.

3. Project Process

All projects follow our standard process, which includes discovery, planning, design, development, launch, and support phases. Specific deliverables, timelines, and payment terms will be outlined in a separate project agreement or statement of work.

4. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information as required for the project
• Review and provide feedback on deliverables in a timely manner
• Provide content, images, and other materials as agreed upon
• Make payments according to the agreed payment schedule
• Obtain any necessary permissions or licenses for materials provided to us

5. Intellectual Property Rights

Upon full payment, you will own the rights to the custom design elements created specifically for your project. However, we retain ownership of pre-existing materials, frameworks, systems, and code libraries used in the development of your website.

We reserve the right to display and link to your completed project as part of our portfolio and to write about the project on websites, in magazine articles, and in books about web design.

6. Payment Terms

Payment terms will be specified in your project agreement. Typically, we require a deposit before work begins, with remaining payments made at specific project milestones.

If you fail to make any payment by the due date, we reserve the right to suspend work on your project until payment is received.

7. Limitation of Liability

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of our services.

8. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

9. Termination

Either party may terminate the service agreement with written notice if the other party breaches any material term or condition and fails to remedy the breach within 14 days of being notified.

In the event of termination, you will be responsible for payment for all services performed up to the date of termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website. Your continued use of our services after such modifications will constitute your acknowledgment of the modified Terms.
